Tips

  • Call it an offer letter, not a contract, and keep the at-will paragraph so the letter does not promise employment for a fixed time.
  • A salary alone does not make a job exempt from overtime: federal law also needs at least $684 a week ($35,568 a year) and duties that meet the exemption tests, and some states set a higher salary.
  • If your state requires a pay range in job postings, keep the offer inside the range you posted.
  • General information, not legal advice. Employment law differs by state; have an employment lawyer review documents you rely on.

Frequently Asked Questions

What should a job offer letter include?
The job title and who the person reports to, the start date, the pay and how often it is paid, the schedule, a short benefits summary, anything the offer depends on (such as a background check or drug screen), the at-will statement and the date you need an answer by.
Is an offer letter a contract?
Usually not, if it says employment is at will and avoids promising a fixed term or guaranteed hours. It is still evidence of what you agreed, so the pay and start date in it should be exactly what you intend.
What does "contingent on a background check" require?
A background check bought from a screening company is covered by the federal Fair Credit Reporting Act: you need the candidate's written permission first, and you must send notices before and after turning someone down because of the report. Many states and cities also limit when you can ask about criminal history.
Can I take back a job offer?
In an at-will state you generally can, but never for a discriminatory reason, and a candidate who quit a job or moved because of the offer may have a claim. Talk to an employment lawyer before you rescind an offer that was accepted.
